Our professionals at Capstan join the CRE Management, Sourcing, Legal and Human Resources negotiations team.  We start our support with a work plan and deal hurdle checklist.  In typical RFP and BAFO processes, we will already establish many of the contract terms and conditions with the bidders before reaching the negotiation phase.  But there are always more details to be agreed upon, particularly where the bids are contingent on due diligence and site visits by the service provider.
During due diligence, we provide project management support, coordinating the exchange of information, helping to resolve questions and escalating issues when appropriate. We manage work streams for both “in-bound” and “outbound” due diligence.

We analyze and quantify the commercial impact of proposed changes in terms of the MSA and scenarios such as portfolio expansion/contraction or changes in inflation, currency conversion rates or taxes.

We develop “must haves” and “nice to haves” for each area and serve as a go-between for the client and the bidder on contentious issues.

We assist in negotiation of the final performance measurement KPIs scorecards, staffing levels, change order procedures and other business details in the contract.  We provide contract version control, validation of the final MSA exhibits, communication to internal and external constituents and written job descriptions.
